Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Kue Labs, Inc., a Delaware corporation that operates Followny ("Followny", "we", "us"). By using Followny you agree to these Terms.
1. Eligibility
You represent and warrant that you are at least 13 years old and are not a resident of, and are not accessing Followny from, the European Economic Area, the United Kingdom, Switzerland, the Republic of Korea, or Brazil (the "Excluded Regions"). Followny is not directed to, offered to, or intended for residents of the Excluded Regions, and we do not target those markets. If we learn a user is a resident of an Excluded Region, we may suspend or terminate that account and delete associated data. Your eligibility representation is a condition of, and material to, our agreement to provide the Service.
2. What Followny is
Followny is an informational tool that reads public Instagram data only. It never requires an Instagram login or password, and never accesses private accounts, direct messages, or credentials. Followny is an independent service and is not affiliated with, endorsed by, sponsored by, or in any way officially connected with Instagram, Meta Platforms, Inc., or any of their subsidiaries or affiliates. "Instagram" and "Meta" are trademarks of Meta Platforms, Inc. All product and company names are trademarks of their respective owners; any use is for identification only and does not imply endorsement.
3. Acceptable use
You are responsible for ensuring that your own use of any information obtained through Followny complies with all applicable laws and with the terms of any third-party platform to which you are a party. Followny does not log in to, authenticate with, or agree to the terms of service of Instagram or Meta, and does not act within or on behalf of any Instagram or Meta account; Followny obtains publicly available information through independent third-party data providers.
You agree NOT to use Followny to:
- stalk, harass, intimidate, threaten, surveil, or locate any person;
- contact, approach, or attempt to identify the physical whereabouts of any person;
- collect, compile, re-publish, or dox another person's information;
- use the Service against any person who has obtained a protective or restraining order against you, or in violation of any such order;
- screen or evaluate any person for employment, tenancy, credit, insurance, or volunteer or background-check purposes; or
- make any automated or adverse decision about any person.
Violation may result in immediate termination and referral to law enforcement. You are solely responsible for how you use the information.
4. Not a consumer report
Followny is not a consumer reporting agency, and no information provided is a "consumer report" or "investigative consumer report" under the federal Fair Credit Reporting Act (15 U.S.C. §1681 et seq.) or any state consumer-reporting or "mini-FCRA" law (including, without limitation, the California ICRAA and CCRAA, the New York FCRA, and Vermont's Fair Credit Reporting statute). Followny does not investigate, verify, or assemble information for, and you may not use it as a factor in, establishing eligibility for credit, insurance, employment, housing, tenancy, or any other FCRA-regulated purpose. Followny is for personal, non-commercial informational and entertainment purposes; information is drawn from public sources, is not verified for accuracy, and must not be relied upon to make decisions about any person.
5. Accuracy, data sources & service interruption
Followny obtains information from publicly accessible sources and third-party data providers on a best-effort basis. Data capture is partial (typically a fraction of all activity), and changes are detected at the time of a check — not the exact time an action occurred. Followny does not itself log in to, authenticate with, or bypass any login, paywall, or technical access control of Instagram or any other platform. Access to public data may be incomplete, delayed, or unavailable, and platforms may change, throttle, or block access at any time; any resulting interruption or gap is not grounds for a refund, credit, or dispute.
6. Billing, refunds & disputes
Subscriptions bill monthly or annually depending on the plan you choose, and renew automatically until cancelled. You can cancel anytime through the Stripe customer portal from your account settings; your plan stays active until the end of the current billing period and does not renew. Followny also offers time-limited Tools Passes: one-time, non-recurring purchases that grant immediate access to the tools surface for a fixed period and then expire — they never auto-renew, and once used are non-refundable except where required by law. All sales are final except for narrow exceptions required by law. You agree not to file a fraudulent chargeback or payment dispute; please contact support first. 7. AS-IS; limitation of liability
The Service is provided "AS-IS" and "as available", without warranties of any kind, at your own risk. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUE LABS, INC. AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100. Nothing in these Terms limits liability that cannot be limited under applicable law, including for fraud, gross negligence, willful misconduct, or personal injury caused by our conduct.
8. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Kue Labs, Inc. and its officers, employees, and agents from any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) to the extent arising out of: (a) your misuse of the Service; (b) your violation of these Terms or any applicable law; or (c) your violation of any third party's rights, including any Instagram user whose public information you access, view, or act upon through the Service. This does not apply to any claim to the extent caused by Followny's gross negligence or willful misconduct, and nothing here limits any right you have under mandatory consumer-protection law.
9. Copyright
Followny does not maintain a durable archive of Instagram photos or videos, and all content shown remains the property of its owners. To display media in your browser, and to deliver a download you request, Followny retrieves it from Instagram's servers and passes it through transiently — the files themselves are not stored on our systems. Downloads are provided for your personal use: you are responsible for how you use material belonging to someone else, and you should obtain the owner's permission before republishing or redistributing it. If you believe content displayed through Followny infringes your copyright or other rights, email followny.info@gmail.com and we will review and, where appropriate, remove or disable access to the identified material.
10. Governing law & dispute resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. You and Kue Labs, Inc. agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, under the Federal Arbitration Act. The arbitrator decides all issues, including the scope and enforceability of this arbitration agreement.
YOU AND KUE LABS, INC. WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Disputes will be arbitrated only on an individual basis. If this class-action waiver is found unenforceable as to a particular claim, then that claim (and only that claim) will be severed and heard in court, while the remaining claims proceed in arbitration.
Small-claims and opt-out. Either party may bring an individual claim in small-claims court instead of arbitration. You may opt out of this arbitration agreement by emailing followny.info@gmail.com within 30 days of first accepting these Terms; opting out does not affect the rest of these Terms. For any matter not subject to arbitration, the state and federal courts located in Delaware will have exclusive jurisdiction and venue. If any provision of this Section is held invalid, the remainder stays in effect, except that the class-action waiver is not severable from the arbitration agreement.
11. Changes to these Terms
For non-material changes, updated Terms take effect when posted with a new "Last updated" date. For material changes to pricing or to how we use your data, we will give reasonable advance notice by email and/or in-app before the change takes effect, and continued use after the effective date constitutes acceptance; if you disagree, stop using the Service and cancel before the effective date. Any change to the arbitration or dispute-resolution terms will not apply to you unless you affirmatively agree or do not opt out within 30 days of our notice.
